EU urged to regulate on-chain perpetual contracts under existing MiFID II rules, avoiding new laws.

The Hyperliquid Policy Committee has formally proposed to the European Commission that on-chain perpetual contracts (perps) be regulated under the existing MiFID II framework rather than creating new legislation. This approach aims to close regulatory gaps after the Markets in Crypto-Assets (MiCA) transitional period ended, by applying current EU rules to these blockchain-based derivatives. The committee emphasizes technology neutrality, arguing that products should be judged by their function, not their technology, and suggests easing retail restrictions that apply to similar products like CFDs. They also advocate reducing redundant reporting since blockchain data is publicly accessible. This move could streamline regulation and support decentralized trading in Europe without lengthy legislative delays.

The Hyperliquid Policy Committee's proposal to regulate on-chain perpetual contracts under MiFID II is presented alongside Pluang's market snapshot as of Oct 01, 2026 19:47 WIB.
